Terms of Service for Tsiyon
Welcome to Tsiyon! These Terms of Service ("Terms" or "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and Tsiyon ("we," "our," or "us"), governing your access to and use of the Tsiyon mobile application, website, and associated services (collectively, the "Service").
PLEASE READ THESE TERMS CAREFULLY BEFORE USING TSIYON. BY CREATING AN ACCOUNT, ACCESSING THE APP, OR JOINING OUR BETA WAITLIST, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICE.
1. Governing Law & Legal Jurisdiction
These Terms and any legal dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the Republic of Uganda, without giving effect to any principles of conflicts of law.
You agree that any legal action, suit, or proceeding arising out of or relating to these Terms shall be instituted exclusively in the competent courts of Kampala, Uganda, and you irrevocably submit to the jurisdiction of such courts.
2. Eligibility & Minimum Age Requirement (13+)
To register for an account or use Tsiyon, you must be at least 13 years of age. By accessing or using the Service, you represent and warrant that:
- You are 13 years of age or older.
- You have the legal capacity and authority to enter into these Terms under Ugandan law or the laws of your local jurisdiction.
- You have not been previously suspended or removed from the Tsiyon platform.
3. Account Registration & Security
To access most features of Tsiyon, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information.
- Keep your password confidential and secure. You are solely responsible for all activities that occur under your account credentials.
- Immediately notify Tsiyon at security@tsiyon.app if you suspect any unauthorized access to or compromise of your account.
4. Christ-Centered Community Standards & Content Moderation
Tsiyon is built as a sanctified social home dedicated to fostering wholesome, family-friendly, and Christ-centered fellowship. We maintain strict community standards to protect our users and preserve an uplifting environment.
A. Prohibited Content
You agree not to create, upload, post, transmit, or share any content that:
- Contains profanity, explicit language, blasphemy, or sexually suggestive imagery/nudity.
- Promotes hatred, discrimination, harassment, bullying, or violence against any individual or group.
- Depicts or promotes self-harm, illegal activities, substance abuse, or illegal weapons.
- Contains false, deceptive, fraudulent, or misleading information (including impersonation of others).
- Promotes commercial spam, unauthorized advertising, multi-level marketing, or phishing schemes.
- Infringes upon any third party's intellectual property, privacy, or publicity rights.
B. Content Moderation & Enforcement
To maintain family-friendly standards, Tsiyon utilizes automated AI screening technology alongside community reporting mechanisms.
Tsiyon expressly reserves the right, in its sole and absolute discretion, to:
- Review, screen, flag, refuse, or remove any User-Generated Content at any time without prior notice.
- Issue warnings, temporarily restrict account features, or permanently suspend/terminate accounts that violate these Community Guidelines.
5. Beta Software Addendum
Tsiyon is currently offered in pre-release, early access, and Beta testing stages. By participating in the Tsiyon Beta, you acknowledge and agree to the following additional terms:
- Experimental Nature: The Beta Service is pre-release software under active development and may contain bugs, errors, glitches, or inaccuracies.
- As-Is Availability: The Beta Service is provided strictly on an "AS-IS" and "AS-AVAILABLE" basis. Tsiyon makes no representations or warranties regarding uptime, reliability, or continuous service availability.
- Service Modifications & Data Resets: Tsiyon reserves the right to modify, update, suspend, or discontinue any feature, or perform database resets, at any time during the Beta phase without liability to you.
- Feedback: Any ideas, feedback, bug reports, or suggestions you provide regarding the Beta Service become the sole property of Tsiyon, and we may use them without restriction or obligation to compensate you.
6. User Content & Intellectual Property License
A. Ownership of Your Content
You retain all ownership rights in the text, photos, posts, messages, and other content you submit to Tsiyon ("User-Generated Content").
B. License Granted to Tsiyon
By posting or transmitting User-Generated Content on or through the Service, you grant Tsiyon a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, reproduce, modify (solely for technical formatting purposes), and distribute your content strictly for the purpose of operating, developing, providing, and promoting the Service.
7. Tsiyon Intellectual Property
All intellectual property rights in the Tsiyon platform — including the Tsiyon brand name, logos, deep red Material 3 design system, source code, visual interface layouts, graphics, and trademarks — are the exclusive property of Tsiyon.
Except as explicitly permitted in these Terms, you may not copy, modify, distribute, reverse engineer, or create derivative works from any part of the Tsiyon Service without our express written consent.
8. Termination & Account Cancellation
- Termination by You: You may stop using the Service and request deletion of your account at any time through the app settings or by contacting support@tsiyon.app.
- Termination by Tsiyon: We reserve the right to suspend, disable, or terminate your account or access to the Service immediately, with or without notice, if you breach these Terms, violate our Community Guidelines, or engage in conduct harmful to the Tsiyon community or brand reputation.
- Effect of Termination: Upon termination, your right to use the Service immediately ceases, and any licenses granted to you under these Terms will automatically terminate.
9. Disclaimers & Limitation of Liability
A. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF THE REPUBLIC OF UGANDA, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
B. Limitation of Liability
IN NO EVENT SHALL TSIYON, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- YOUR USE OF OR INABILITY TO USE THE SERVICE.
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
- ANY INTERRUPTION, BUG, VIRUS, OR SERVICE SUSPENSION DURING BETA TESTING.
IN NO EVENT SHALL TSIYON'S AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED US DOLLARS ($100 USD) OR THE EQUIVALENT AMOUNT IN UGANDAN SHILLINGS (UGX) PAID BY YOU TO TSIYON IN THE PAST SIX MONTHS.
10. Indemnification
You agree to defend, indemnify, and hold harmless Tsiyon, its legal representatives, officers, directors, and employees from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your access to or use of the Service.
- Your User-Generated Content.
- Your violation of these Terms or any applicable laws of Uganda.
11. Changes to Terms
We reserve the right to modify these Terms at any time. When material updates are made, we will notify you by updating the "Last Updated" date at the top of these Terms and delivering an in-app notice or email notification. Continued use of the Service following effective notice constitutes your binding acceptance of the revised Terms.
12. Severability & Entire Agreement
If any provision of these Terms is found to be unlawful, void, or unenforceable under Ugandan law, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. These Terms and our Privacy Policy constitute the entire legal agreement between you and Tsiyon regarding the Service.
